While society debates whether and how to use public funds to support work on human embryonic stem cells, many scientific groups and businesses debate a different question — the extent to which patents that cover such stem cells should be permitted to limit or to tax their research. The Wisconsin Alumni Research Foundation, a non-profit foundation that manages intellectual property generated by researchers at the University of Wisconsin at Madison, owns three patents that have been at the heart of the (...) latter controversy. The story of WARF’s patents and the controversy they have fostered highlights not only continuing tensions between proprietary and nonproprietary approaches to developing science and technology, but also an at least partly reassuring capacity of public and private sectors to deal with those tensions in a way that can render them substantially manageable, and frequently more manageable as a technology matures. This volume offers an English translation of John of St. Thomas's Cursus theologicus I, question I, disputation 2. In this particular text, the Dominican master raises questions concerning the scientific status and nature of theology. At issue, here, are a number of factors: namely, Christianity's continual coming to terms with the "Third Entry" of Aristotelian thought into Western Christian intellectual culture - specifically the Aristotelian notion of 'science' and sacra doctrina's satisfaction of those requirements - the Thomistic-commentary tradition, and (...) the larger backdrop of the Iberian Peninsula's flourishing "Second Scholasticism." In this latter context, John of St. Thomas applies the theological principles of Thomas Aquinas to the Scholastic disputes preoccupying Thomist, Franciscan, and Jesuit theologians, such as Cajetan, Bañez, Luis de Molina, Vazquez, Suárez - to name only a few - in a tour de force of theological thinking throughout the entire period of Scholasticism. In the process - and not insignificantly - the status quaestionis of theology's scientific character is clearly framed and answered according to John's satisfaction. Key to John of St. Thomas's resolution of the question is his understanding of the continuity of the power of human reason with the super-intelligibility of divine revelation spelled out in terms of what he calls "virtual revelation." This text presented in this volume is a quintessential example of the deep and abiding harmony that flourished between faith and reason as well as grace and nature within the golden era of Baroque Scholasticism. Reciprocity is a fundamental aspect of social life, and a phenomenon studied from a wide variety of philosophical, theological, and social scientific perspectives. In this study, we use social exchange theory to investigate why employees help other employees. We hypothesize, based on the norm of reciprocity (Gouldner, 1960), that a significant cause of an employee''s helping behavior is how much organizational citizenship behavior (OCB) the employee has received from coworkers. To provide evidence of the discriminant validity of OCB received as (...) an antecedent of helping behavior, we also assess its effects on another form of extra-role behavior, voice, as well as in-role performance. We found, in a sample of 157 employee-supervisor dyads, that OCB received was related to helping behavior after controlling for several antecedents of helping behavior identified in past research, and was less related to voice and in-role behavior, as hypothesized. John Rist surveys the history of ethics from Plato to the present and offers a vigorous defence of an ethical theory based on a revised version of Platonic realism. In a wide-ranging discussion he examines well-known alternatives to Platonism, in particular Epicurus, Hobbes, Hume and Kant as well as contemporary 'practical reasoners', and argues that most post-Enlightenment theories of morality depend on an abandoned Christian metaphysic and are unintelligible without such grounding. He also argues that contemporary choice-based theories, whether (...) they take a strictly ethical or more obviously political form, are ultimately arbitrary in nature. Substantial in every way, it is physically imposing, magnificently printed on heavy, glossy stock and profusely illustrated with splendid color reproductions of all the master’s major works and many sketches and preparatory drawings, as well as etchings and dry-point engravings. (...) Gary Schwartz, who studied art history at New York University and Johns Hopkins University, is now living in the Netherlands. The merits of his book are enormous. Not only is it filled with magnificent reproductions, there are tables and graphs detailing such things as the number of Rembrandt paintings in catalogues from 1836 to 1992; analyses of the artist’s borrowings and adaptations in five-year periods; key dates in the life of the man; Rembrandt’s relation to the forms of sale for paintings in the Dutch seventeenth century; and so on. There is even a computer rendering of the famous depiction of Captain Banning Cocq’s Company of Guards at the Gates of Amsterdam (popularly called The Night Watch), specifying the weapons shown and identifying all present, either by name and title or by a description, such as “girl in gold and blue,” “pikeman,” “musketeer,” etc.A sampling of the chapter headings and subcategories suggests just how comprehensive is Schwartz’s treatment: 1. Introduction, 2. A Dutch Artist’s Life, 3. Family, Loved Ones, Households, 4. Craft, 5. Earning and Spending, 6. Patrons, 7. Landscape, 8. Humankind, 9. Man and God. Just the specifics of the last chapter are remarkably capacious: Holy Family; Christ’s Ministry; Passion, Death and Afterlife; Divine Intervention; Holy People; Moral Examples from the Old Testament; The Man of God, Simeon; Afterlife; and Rembrandt as a Christian Rhetorician of the Brush. It’s hard to imagine a better reference for the lay reader than The Rembrandt Book.The book is also full of interesting contrasts of opinion as well as some surprising remarks. As for one of the latter, Schwartz writes that Rembrandt’s “portraits are said to be more ‘psychological’ than those of his contemporaries. What this might mean I frankly do not understand” (213). He goes on to note that the field of psychology did not exist in Rembrandt’s time. However, from long before its invention people spoke of Rembrandt’s ability to reveal the soul of the sitter. Indeed, the reason I was not surprised, although somewhat distressed, when the Rembrandt Research Project—a group of connoisseurs set up in 1969 with the explicit charge of authenticating all works ascribed to the master—announced in 1985 that The Man with a Golden Helmet in Berlin was not by the master at all, was that I had all along been troubled by this face that lacked the quality of animation in repose so [End Page 115] characteristic of Rembrandt portraits. Schwartz thinks the artist would have to have relied upon the ancient theory of the humors to do “characterological descriptions” of his sitters, and that in portraiture, “such characterizations would quickly resemble caricatures.” And, indeed, they do, but in profoundly subtle ways, much as someone like the popular illustrator Norman Rockwell employed tiny caricature-like distortions to project a kind of homely Americanism. I’m not comparing Rockwell to Rembrandt but choosing a realistic illustrator in whose work the trick is more apparent. Caricature can be as broad as it is in Jacques Callot, William Hogarth, or Honoré Daumier and yet be a feature of true art. Or so it seems to me, admittedly, a sometimes cartoonist as well as painter and engraver.Schwartz’s completeness of coverage leads him to include, in addition to superb drawings and prints, some that are so careless and hasty as to make one doubt their authenticity. G. Deledalle is the author of a Histoire de la philosophie américaine, and of some excellent studies on Dewey, such as La pédagogie de Dewey, philosophie de la continuité, and "Durkheim et Dewey". These are all works that deserve full attention by students of the Golden Age of American philosophy. For a European, Deledalle has an unusual capacity to detect the vitality and freshness, but also the depth, of the growth of higher education in the U.S. in the first (...) half of this century. At the heart of this growth were philosophical ideas, and in particular those of Dewey. Philosophy did not have then dictatorial or competitive designs regarding education, the social and political sciences, psychology, or the natural sciences. It freely mingled with them, not just imparting methodological or epistemological rigor but also contributing some insights and giving the hypotheses and conclusions in these fields the character of "experiences." Experience is the guiding theme of this rich and complicated work, covering a multitude of subjects and positions. The treatment is divided into six parts dealing respectively with Dewey's leanings toward unitary experience, organic experience, dynamic experience, functional experience, instrumental experience, and transactional experience. In the study of the intellectual of Dewey's life practically all of his production is critically examined by Deledalle: a monumental task in itself, made possible by the critical bibliography of Milton Hasley Thomas. There is enough early biographical detail to make this work an effective and affectionate intellectual portrait. The best pages of this work are devoted to a thorough explication and comparative study of Dewey's final synthesis of experience. There are very helpful comparative references to Marx, Freud, Bergson, and Heidegger, and also indispensable parallels and contrasts with Peirce, James, and Whitehead. This is not a modest contribution from a regional point of view: Deledalle is, perhaps more than anybody else, aware of an ongoing international dialogue on Dewey, a dialogue that is preserving experience as a problem-complex at the front line of contemporary reflection.--A. de L. I suffered a broken hand, femur, multiple lacerations and the most (...) severe injury of them all, the loss of my right leg just below the knee. I kept the fact that I owned a motorcycle from my parents by storing it at a friend’s house so I knew the news of my injury would be twice as surreal to them. I remember telling the ER nurse that I needed to be the one that called them to tell them what happened. She said she could not do that, but I told her that she did not know my mother and I was able to talk her into accommodating me.It was the summer between my junior and senior year of college and I had had just made Indiana University’s football team as a walk–on linebacker (without having played HS football) so life was good and there was pretty much nothing holding me back or anything I felt I could not do.In an instant the life I once knew would never be the same and I truly wanted to die but little did I know that life would get better, not worse. After keeping my lower leg attached with surgical tape for a week, the inevitable could not be avoided. It was devastating news. At first I refused to sign any papers authorizing the amputation surgery but I was told if I did not, I would surely die as gangrene had set in. I remember scribbling my signature and then throwing the pen—a doctor’s dream I’m sure but I have to believe they’ve seen it all before. I was in traction for the first six weeks and had lost 60 pounds. Two weeks after being removed from traction I was able to get upright but was extremely weak. The emaciated and ghostly white image of me was tough to look at in the mirror, especially with half my right leg missing. That really took some getting used to. At that point, it was like a bad dream and I wasn’t sure what to make of all of it but one thing for certain was that reality had sunk in. Surprisingly, it was at that point that I quit feeling sorry for myself and instantly knew what had to be done.I knew I needed help and I could not do it alone so with the help of my family and friends, I started to put goals in place for myself. First on the list was to gain some weight back so I resumed working out (mostly weightlifting) and turned to my mother’s [End Page 192] great cooking. There were some highs and lows during that process particularly with my first prosthetist (also an amputee) who told me my days of any type of sports activities “were over.” That was pretty devastating news to me but it didn’t take me long to realize he was only telling me things that he himself was never able to accomplish as an amputee and that just created more of an incentive for me because I knew deep down it was possible because I already had the drive and determination. Just under a year later I was back to a regular exercise program, my “pre–accident” weight and feeling healthy and in shape again.I have since become more appreciative of what I have. I used to box in college and in 1991, entered the Chicago Golden Gloves Super heavyweight (senior novice) division. Senior novice means you’ve had five or less fights at that time and that you were at least 21. I lost my first fight in 1991 on a controversial decision and came back in 1992 and had three fights. Michael Huemer has argued for the justification principle known as phenomenal conservativism by employing a transcendental argument that claims all attempts to reject phenomenal conservativism ultimately are doomed to self-defeat. My contribution presents two independent arguments against the self-defeat argument for phenomenal conservativism after briefly presenting Huemer’s account of phenomenal conservativism and the justification for the self-defeat argument. My first argument suggests some ways that philosophers may reject Huemer’s premise that all justified beliefs are formed on the basis of seemings. (...) In the second argument I contend that phenomenal conservativism is not a well-motivated account of internal justification, which is a further reason to reject the self-defeat argument. Consequently, the self-defeat argument fails to show that rejecting phenomenal conservativism inevitably leads one to a self-defeating position. (shrink)

In a recent article, Erik Wielenberg has argued that positive skeptical theism fails to circumvent his new argument from apparent gratuitous evil. Wielenberg’s new argument focuses on apparently gratuitous suffering and abandonment, and he argues that negative skeptical theistic responses fail to respond to the challenge posed by these apparent gratuitous evils due to the parent–child analogy often invoked by theists. The greatest challenge to his view, he admits, is positive skeptical theism. To stave off this potential problem with his (...) argument, he maintains that positive skeptical theism entails divine deception, which creates insuperable problems for traditional theism. This essay shows that Wielenberg is mistaken. Although positive skeptical theism claims that we should expect the appearance of gratuitous evil given Christian theism, this does not entail divine deception. I maintain that God is not a deceiver on positive skeptical theism because God does not meet two requirements to be a deceiver: God does not intend to cause people to believe any false propositions and God does not provide evidence for someone to justifiably believe a false proposition. Consequently, Wielenberg’s new argument from evil fails and positive skeptical theism remains a viable response to the evidential argument from evil. (shrink)

Michael Bergmann has argued that internalist accounts of justification face an insoluble dilemma. This paper begins with an explanation of Bergmann’s dilemma. Next, I review some recent attempts to answer the dilemma, which I argue are insufficient to overcome it. The solution I propose presents an internalist account of justification through direct acquaintance. My thesis is that direct acquaintance can provide subjective epistemic assurance without falling prey to the quagmire of difficulties that Bergmann alleges all internalist accounts of justification cannot (...) surmount. While there is no shortage of philosophical literature discussing knowledge by acquaintance, there is a surprising dearth of work about theories of epistemic justification based on direct acquaintance. This paper explores a basic framework for a thoroughly general account of epistemic justification by acquaintance. I argue that this approach to epistemic justification satisfies two importance aspects of justification. After sketching how the acquaintance approach can meet both objective and subjective aspects for epistemic justification, I will outline how this general account (...) of justification by acquaintance can be applied to the analysis of justification for many types of beliefs. Finally, some of the objections to the acquaintance approach will be considered and answered. (shrink)

Arguments in natural theology have recently increased in their number and level of sophistication. However, there has not been much analysis of the ways in which these arguments should be evaluated as good, taken collectively or individually. After providing an overview of some proposed goals and good-making criteria for arguments in natural theology, we provide an analysis that stands as a corrective to some of the ill-formed standards that are currently in circulation. Specifically, our analysis focuses on the relation between (...) the veracity of the premises and their relation to the conclusion of an argument. In addition to providing a clearer account of what makes an argument good, an upshot of our account is that there remain positive contributions for "weak" arguments, especially within cumulative case arguments in ramified natural theology. In this volume he recounts its rise, assesses it, and suggests its revision.For Krieger, theory is a continuation (...) of traditional institutional battles. The debate between the old historical scholarship and the new criticism, which he describes in his first chapter, parallels the current debate between new historicism and deconstruction (p. 25). But Krieger shows that there is a much older parallel in the debate between the Tories with their myth of the Golden Age and the Whigs with their myth of progress (p. 27). American criticism divides itself between formalists who emulate “the great literatures of the West” (p. 35) and historicists who value literature “shaped by and... reflect[ing] American experience” (p. 35). For Krieger, the ancient quarrel between formalism and historicism is the real context for this century’s debate between new criticism and the older and newer historicisms (p. 38–40).The first of his four chapters describes the old historicism’s resistance to theory, especially its resistance to the formal principles of the new criticism, the preinstitutionalized theory of the 1950s. The new criticism could be defended as being “for the text” (p. 8), but the theories that came after it—structuralism, poststructuralism, and their “interdisciplinary mixtures” (p. 10)—established successive hybrids built upon “the domain of contingency” (p. 12). Krieger argues that this process, coupled with the rise of human sciences and the demystification of literary values, has resulted in a full-scale assault upon institutions, advancing the “anti-institutional institution” (p. 19) of theory and replacing discipline-based “academic structures” (p. 19).Thankfully, Krieger mitigates these relatively crude oppositions by discussing how poststructuralism has energized the intramural debates within the theoretical camps. In the end he finds the current opposition between deconstruction (with its embrace of textuality) and new historicism (its embrace of contingencies) to be an either/or fallacy. The “poem... helps create history,” he asserts, “even as... history had to help create the poem” (p. 45).In his third chapter, Krieger relies upon this “middling” insight to describe [End Page 403] the fight between those who see literary works as tools of ideology and those who regard them as resistant to ideology (p. 48). The tradition of resistance may support “a given ideological structure,” but at the same time it believes that literature is a “structure of complexities that eludes any attempt to make [it] into an ideology’s servant” (p. 55). And so Krieger escapes from “unified meaning” (p. 64), an escape he traces through a history of literary thought that culminates in Paul de Man.Krieger is now ready for some classifying of his own: the new historicism in one category, grouped with the ideological (closed, totalizing, and controlling traditions); deconstruction in a separate category, grouped with the counterideological (open and liberating traditions). He does not reject ideological theories out of hand; he proposes “a balancing act [of letting] loose the counterideological potential of” certain texts “while resisting the universalizing thematic consequences” of this very process (p. 76).Having traced the institutionalization of theory, having contextualized and thus legitimized the many sides of contemporary theory’s debates, Krieger concludes by uttering an enlightened “plea for theory to reengage the lingering promise of the aesthetic [and] to allow a chance for the extraordinary particular, which is not already contained within a ruling universal” (pp. 90, 91).
